On December 1, 2009 Federal Rule of Civil Procedure 6 and Federal Rule of Criminal Procedure 45 will adopt a uniform
time-computation method, which simplifies the method for determining time periods. The new rules will use a "days
are days" approach to computing all time periods, which will include the counting of intermediate weekend days and
holidays. Under the present rules, intermediate weekend days and holidays are sometimes counted, but sometimes not.
For further information on the federal rule changes, you can refer to the U.S. Courts' Federal Rulemaking Website.
For consistency purposes, several Local Civil Rules of Procedure and Standing Orders have been modified for the
"days are days" approach to computing time periods. New Local Rule 6.2 has also been created to define when the
clerk's office is inaccessible.
